CE Marking

What is CE Marking?

CE Marking is the manufacturer's declaration showing compliance with all applicable directives. For most products sold in the EU, the use of CE Marking and a Declaration of Conformity are mandatory.


With the exception of some high-risk products, most products can be self- assessed by the manufacturer to meet the Essential Requirements. While CE Marking permits a product's access to the EU, it is not an approval certification or quality mark; nor is it intended to be a marketing tool. CE is a "Marking" that is only a declaration of the supplier's own responsibility. While enabling products to be placed on the European market, it only allows for the free movement of goods and permits the withdrawal of non-conforming products.

The CE Marking should not be confused with other approval marks or certifications issued by an EU-accredited certification body. As stated in the European Commission's Guide to the Implementation of Community Harmonization Directives:

"Manufacturers are responsible for ensuring that the products they place on the market meet all relevant regulations. Where these regulations do not require mandatory certification, manufacturers often seek voluntary certification to assure themselves that their products do meet the requirements set by law."

The main goals of the CE Marking are to:

  • indicate a product's conformity with the "essential requirements" of the directives
  • allow products to be "placed on the market"
  • ensure the "free movement of goods"
  • allow the "withdrawal of non-conforming products" by customs and enforcement authorities

CE Marking:

  • is not a mark or certification or approval issued by a third party
  • is not a marketing or promotional tool
  • is not a quality mark
  • is not for components (Although there are some exceptions, the vast majority of components do not need CE Marking.)

At this moment several CE marking Directives are in force. The main intention of these Directives is to ensure free movement of products within the European Community. With these Directive the manufacturers has become fully liable for products brought onto the European market. TÜV EPS recognizes that manufacturers may still need an independent third party verification regarding compliance testing with several Directives in order to be able to respond to requests from customers and to limit their liability and to obtain an presumption of compliance with the essential requirements of these Directives.

As a Notified Body for Article 10.2 of the EMC Directive 89/336/EC TÜV Rheinland EPS can assess Technical Construction Files and issue a certificate of compliance. Also testing of products in accordance with (harmonized) standards can be used in conformity assessment procedures for many EU Directives to obtain an presumption of compliance with the relevant essential requirements. TÜV Rheinland EPS can help to select the proper standards and test accordingly.

TÜV Rheinland EPS is a Notified Body for the R&TTE Directive 1999/5/EC (Annexes III and IV). TÜV EPS can provide you with all the services needed in order to verify and confirm compliance of your radio and telecommunications equipment with the latest European regulations.

TÜV Rheinland EPS can also help you in selecting the proper labeling related to non harmonized use of Radio equipment in Europe. If equipment is considered "non harmonized" or is not considered Class 1 equipment, appropriate information has to be provided to the user about possible restrictions. (art. 6.3 of the R&TTE Directive). In this case notification to EU Member states is necessary and TÜV Rheinland EPS can perform these notifications for you.
